A parent may choose to deny consent for emergent bilingual services, but if they do so, the student will still be considered an English learner. The school will continue to monitor them until two years after they have been determined to be English proficient.
Steps
To complete parent denial documentation:- Parental Notification of Initial Identification and Approval of Placement
- There are three form variants; one for Transitional Bilingual, DLI, and ESL. Use the correct variant based on the placement recommendation.

If the parents end up granting their consent for services once the benefits have been explained to them, the student will receive services as recommended by the LPAC.

- The student will receive services as recommended by the LPAC and at the end of the year, will need an LPAC Annual Review.
If the LPAC team recommended the student be placed in either DLI or BEP, the parents can request that the student enters the ESL program instead.

To switch a student from BEP to ESL:- Parental Denial - Bilingual
- The parent should select I do not want my child to participate in the bilingual education program that the LPAC has recommended; however, I do want my child to participate in an English as a Second Language (ESL) program.
- LPAC Annual Review
- The student will receive ESL services and at the end of the year, will need an LPAC Annual Review.
If the parent confirms their denial of consent, even though the student will not receive any specific emergent bilingual services, they will still be classified as an English learner and they will continue to be badged in SameGoal.

- LPAC Annual Review
- The student will not receive any EB specific services, but they will still be considered an English learner and should receive accommodations and take the TELPAS yearly until they reclassify as English proficient.
- At the end of each year until the student reclassifies, create an LPAC Annual Review. Select Continue in General Education as a Parent Denial of Services rather than selecting a placement recommendation.
- Parental Notification on Student Progress - Parental Denial
- After each LPAC Annual Review is completed, you will need to notify the parents of the student's progress.
- Parental Notification of Reclassification and Approval of Exit - Parental Denial
- Once the student is determined to be English proficient, you will need to notify the parents, and then the student can enter 2 years of monitoring.
